The mandate is upheld as a tax, using the coercive — but not unlimited — power that Congress has always possessed. This is a distinction with a very big difference. Had Obamacare been upheld under the Commerce Clause, then our Constitution would have been a dead letter without limits on congressional power. The Court has failed to do its duty. Conservatives should not follow its example — which is what they would do if they now gave up the fight against Obamacare. The law, as rewritten by judges, remains incompatible with the country’s tradition of limited government, the future strength of our health-care system, and the nation’s solvency. We are not among those who are convinced that we will be stuck with it forever if the next election goes wrong: The law is also so poorly structured that we think it may well unravel even if put fully into effect. But we would prefer not to take the risk. The high court’s ruling leaves in place 21 tax increases in the health-care law costing more than $675 billion over the next 10 years, according to the House Ways and Means Committee. Of those, 12 tax hikes would affect families earning less than $250,000 per year, the panel said, including a “Cadillac tax” on high-cost insurance plans, a tax on insurance providers, and an excise tax on medical device manufacturers. “This is a clear violation of the president’s pledge to avoid tax hikes on low- and middle-income taxpayers,” said a statement from the panel, which is chaired by Rep.
